COOKIE POLICY

We inform you that this website (accessible at www.aquasplash.fr ) (the “Website”) is the property of Parques Reunidos Servicios Centrales, S.A., which authorizes SAS MARINELAND, manager of the AQUASPLASH water park and the “Adventure Golf” mini-golf course, to use it (both companies being hereinafter collectively referred to as the “Processors” or the “Publishers”).

This Website uses proprietary and third-party cookies and similar technologies (HTTP cookies, and local storage) that store and retrieve information about users as they browse the Website for the purposes indicated in the section “Cookies and similar technologies used on the Website”.

However, in accordance with the principle of proactive responsibility, we inform you that no personal data is collected or transferred via this Website without first providing the required legal information and obtaining your express consent where necessary.

Below you will find generic information on cookies (different types of cookies and applicable terms and conditions) as well as detailed information on the cookies and similar technologies actually deposited during your visit to the Website (see section “Detailed information on cookies and similar technologies”).

WHAT ARE COOKIES?

Cookies and other similar technologies (flash cookies, web beacons, bugs, etc.) are small files created by websites and downloaded onto your device (computer, cell phone, tablet, etc.) or browsers to store and retrieve certain information about the user (for example, browsing habits or information about your devices and browsers) and his/her use of the websites.

WHAT ARE THE DIFFERENT TYPES OF COOKIES?

We list below some types of cookies based on various classification criteria:

According to the entity that manages the equipment or domain from which cookies are sent and processes the obtained information:

  • First-party or internal cookies: These are cookies sent to your device or browser from a computer or domain managed by the publishers of a website or application, from which the service requested by the user is provided. Here, first-party cookies are those placed by the website's publishers.
  • Third-party cookies: These are cookies sent to your device or browser from a computer or domain not managed by the owners or publishers of a website or application, but by a third party that processes the information obtained through these cookies or similar technologies.
If cookies are sent from a computer or domain managed by the website or application publishers, but the information collected through these cookies is managed by a third party, such cookies will be considered third-party cookies as long as they are used by the third party for its own purposes (e.g., to improve the services it provides or to deliver advertising services on behalf of another entity).

According to the duration that cookies remain active on users' devices and browsers:

  • Session cookies: These cookies are generally used to store information that only needs to be retained for a single service session and disappear once the session expires (e.g., when the browser is closed and the visit ends).
  • Persistent cookies: These are cookies used to store information on the user's device or browser even after the session has ended, allowing the information to be accessed and processed at a later time, defined by the party responsible for the cookie. This period can range from a few minutes to 6 months, unless these cookies are manually deleted by the user. After the 6-month period, the user will be asked to renew their consent for the placement of persistent cookies. If the user refuses, the storage period for persistent cookies will not be extended.

According to their purpose, cookies can be...

  • Strictly necessary cookies (or technical and essential cookies): These cookies allow you to navigate through an application or website and use the different options or services available. They also enable the management and operation of the website or application, such as controlling traffic and data communication, identifying the session, accessing restricted areas, managing payments, controlling fraud associated with service security, or using security features during navigation. This category also includes cookies that allow for better management of advertising spaces. These advertising spaces, which are another design feature or "layout" of the service offered to you, are included on a website or application based on several criteria, including editorial content. However, note that no user information is collected for other purposes, such as personalized advertising or other content. These trackers generally do not require user consent.
  • Performance cookies (analytics or measurement): These are cookies that allow the tracking and measurement of your behavior when visiting a website or application, including in terms of quantifying the advertising impact. The information collected by this type of cookie is used to measure the activity of the website or application, with a view to making improvements based on the analysis of usage data. These trackers may not require user consent if certain criteria are met.
  • Functionality cookies (preference or personalization): These cookies store information to ensure that when you access a given website or application, your experience is unique and different from that of other users: language, number of search results to display when performing a search, appearance or content of a website or application based on your browser type, region, etc. These trackers generally do not require user consent.
  • Behavioral advertising cookies: These are cookies that store information about your behavior, obtained through continuous monitoring of your browsing habits. These cookies aim to efficiently manage and display advertising spaces, enabling the creation of specific profiles that ensure the display of relevant advertisements. These trackers require user consent.
  • Social media cookies: Websites or applications may contain features from third-party websites (e.g., social media) that incorporate scripts or other functionalities capable of reading, and sometimes recording, cookies and similar technologies on your browser or device (usually for behavioral advertising purposes). The publishers of websites or applications that integrate features involving social media cookies or similar technologies have no access to or control over these, nor over the information that third parties may collect, as they manage their own purposes and privacy practices. Therefore, before accepting the installation of these cookies on your devices or browsers, users are advised to consult the privacy policies of the third parties responsible for these cookies and similar technologies. These trackers require user consent.

Below is a list of third parties that may embed these social media cookies and similar technologies on your devices and browsers, along with links to the respective cookie and privacy policies. We recommend reviewing these policies before deciding on the use of such cookies or similar technologies.

USE OF COOKIES AND SIMILAR TECHNOLOGIES

Data Controllers
The Data Controllers are:

  1. SAS MARINELAND, the company that operates the AQUASPLASH water park, with its registered office at 2 Route de la Brague, 06600 Antibes, FRANCE.
  2. Parques Reunidos Servicios Centrales, S.A., a company with its registered office at C/Federico Mompou, 5, Parque Empresarial "Las Tablas", Building 1 - 3rd floor, 28050, Madrid, SPAIN, which manages the central services of the park.

Both companies act individually as Data Controllers and together as joint Data Controllers (the "Data Controllers" or "Publishers"), meaning they have a contractual arrangement and are jointly responsible for the information collected through cookies and similar technologies integrated into this website (except for third-party cookies, which fall under the responsibility of parties other than the Data Controllers).

If you have any questions regarding the processing of your personal data or if you wish to request a copy of the key sections of the agreement between the Joint Controllers, please write to the Data Protection Officer (DPO) at privacy@marineland.fr or to Marineland – DPO – 306 Av Mozart – 06600 Antibes, FRANCE.

Purposes and Legal Basis for Processing
The purposes of the processing are described in the section "Detailed Information on Cookies and Similar Technologies." Except for strictly necessary cookies (i.e., technical and necessary cookies) that are exempt from consent, the legal basis for the processing related to other cookies is your explicit and informed consent, which you can manage and withdraw at any time as described in the section "How to Change Your Cookie Settings or Withdraw Your Consent to the Installation of Cookies and Similar Technologies."

Recipients
The Data Controllers may share the information collected with the following entities:

  • If necessary, with all relevant authorities and bodies, including law enforcement, courts, and the public prosecutor, to comply with any legal obligations applicable to the Data Controllers under European Union and/or national laws.
  • Service providers acting on behalf of and under the instructions of the Data Controllers as data processors. These providers may offer services such as analytics and measurement, personalized advertising, technical services for website operation, user consent management services, etc.
  • Third parties that install cookies or similar technologies from their own domains or from the Data Controllers' domains, where these third parties manage the purposes of these cookies and/or similar technologies and the information they collect. These third parties may include the owners of major social media networks (Twitter, Facebook, Instagram, YouTube, Vimeo, Spotify, etc.).
  • If you consent to the use of behavioral advertising cookies, the information collected (anonymized IPs, device, or browser data) will be processed within the European Economic Area (EEA) by Salesforce, our cloud marketing platform operator. In exceptional cases, such as disaster recovery situations (i.e., the process of recovering lost data and functionalities in case of an accidental or man-made disaster), Salesforce may also process this information outside of the EEA (international data transfer), including in countries that do not offer a level of protection equivalent to that required under European data protection laws. In such cases, the Data Controllers have entered into binding contractual commitments with Salesforce that ensure the implementation of appropriate security measures so that your personal data is always processed with a level of protection comparable to that required within the EEA (standard contractual clauses approved by the European Commission, additional security measures in accordance with the CJEU’s C-311/18 decision, and subject to certification mechanisms). Furthermore, transfers to the United States, which is considered a country providing an adequate level of personal data protection following a European Commission decision on July 10, 2023, may also occur. Salesforce has committed to complying with the new data protection framework resulting from this decision and is listed in the registry maintained by the U.S. Department of Commerce. Data transfers from the European Union to organizations listed in this registry can, therefore, take place freely, without the need for standard contractual clauses or other transfer instruments. For more information, please feel free to contact the Data Protection Officer (DPO) at one of the addresses (postal or email) indicated in the "Rights" section of this Cookie Policy. Please remember that you can refuse the installation of cookies or change your cookie settings. For more information, please refer to the section "How to Change Your Cookie Settings or Withdraw Your Consent to the Installation of Cookies and Similar Technologies."

List of Companies Using Trackers on Our Website and Possible Transfers to Third Countries
Data processing is generally carried out within the European Economic Area (EEA) or in countries demonstrating an adequate level of protection.
However, please note that the website uses cookies and similar technologies from third parties that provide services to the Data Controllers and may store and access the information they collect even outside of the EEA:

Google Cookies
The website uses certain services provided and developed by Google, Inc., a company based in Delaware, USA, with its registered office at 1600 Amphitheatre Parkway, Mountain View, California, CA 94043, USA (“Google”), which utilize cookies and/or similar technologies. These services include:

  • Google Analytics: This is Google’s analytics tool, which allows the Data Controllers to understand how users visiting their website interact, providing usage statistics of the website without necessarily identifying the users (anonymous IP). You can find all the information about how Google Analytics uses cookies and the information it collects at the following link: Google Analytics Cookie Usage.
  • Google AdSense: This service is used by the website to improve advertising. It is generally used to target ads based on content that is relevant to our users, enhance reporting on campaign performance, and prevent showing ads that users have already seen. These cookies do not contain information that allows us to personally identify our users. You can learn more about how Google AdSense uses cookies and the information it collects by clicking on the following link: Google AdSense Information.
  • Google Ads (formerly Google AdWords): This is a service that uses conversion cookies primarily to help the Data Controllers measure how many users who click on their ads end up taking action on the website (for example, by purchasing a product or service). These cookies allow Google and the Data Controllers to determine if users have indeed clicked on the ad and then visited the website. Conversion cookies are time-limited and are not used by Google for personalized ad targeting. You can learn more about how Google Ads uses cookies and the information it collects by clicking on the following link: Google Ads Information.
  • Google DoubleClick: This is a service from Google under the DoubleClick brand that uses cookies to improve ad delivery. They are often used to target ads based on content that is relevant to a user, enhance reporting on campaign performance, and prevent showing ads that users have already seen. DoubleClick cookies do not contain information that allows us to personally identify a user. Sometimes, the cookie contains an additional identifier that looks like an identification cookie. This identifier is used to identify an advertising campaign to which a user has already been exposed. To learn more about how Google AdSense uses cookies and the information it collects, click on the following link: DoubleClick Information.

If you consent to the use of these cookies, the information collected may be processed by Google outside the European Economic Area (EEA) (international data transfer), including to the United States, which is considered a country ensuring an adequate level of personal data protection following a European Commission decision on July 10, 2023. Google LLC has committed to complying with the new data protection framework established by this decision and is listed on the registry maintained by the U.S. Department of Commerce. Transfers of personal data from the European Union to entities listed in this registry can therefore occur freely, without the need for specific safeguards such as standard contractual clauses or other transfer instruments.

For Your Reference:

Please note that you can choose whether or not to install cookies or similar technologies on your devices or browsers. If you accept, you can modify your cookie settings or disable previously installed cookies at any time via the consent management platform used on this website or through the mechanisms provided by various browsers, as described in the section "How to modify your cookie settings or withdraw your consent to the installation of cookies and similar technologies."

Finally, we remind you that following the installation of cookies or similar technologies by third parties, these third parties may carry out international transfers of all data or information collected. You can find out more about this by consulting the privacy and cookie policies of each of these third parties. To facilitate consultation, the Data Controllers have listed some of these third parties, specifying links to their respective privacy and cookie policies in the section "Detailed information about cookies and similar technologies."

You may also withdraw your consent or exercise any other rights you have under data protection regulations, including your rights of access, rectification, erasure, objection, limitation of processing, portability and, where applicable, your right not to be subject to automated individual decisions, including profiling, by sending your request in writing to the Data Protection Officer of the Data Processors at privacy@marineland.fr or Marineland - DPD - 306 av Mozart - 06600 Antibes, FRANCE...

You may also file a complaint with the Cnil.

With regard to third-party cookies, if you wish to know how to exercise your rights under data protection regulations, please refer to their respective cookie and privacy policies. For ease of reference, we have included links to these third parties' cookie and privacy policies in the “Detailed information on cookies and similar technologies” section.
